Bike Service Plans Terms and conditions
1. Organiser
Decathlon UK Limited (“Decathlon UK”, “We”, “we”, “Us”, “us”, “Our” or “our”), Company Number 03140144, whose registered office is situated at Head Office, 9 Maritime Street, London, England, SE16 7FU.
2. Background
These terms and conditions (these "T&Cs") are the terms on which Decathlon UK supply the Service Plan to you ("You", “you, “Your” or “your”). All Decathlon UK retail stores are participating in the Service Plan in the United Kingdom. These Conditions are integral to each Service Plan and are independent of any other contract you might have with Decathlon UK.
3. Definitions and Interpretation.
Benefits: means the benefits of any of the Plan selected and You paid for.
Cooling-Off Period: means the 14-day period from the Start Date.
Payment Method: means your selected payment method to pay for the Plan which can be found in Decathlon Terms of Use.
Plan: this means Your selected Plan in clause 5.
Start Date: means, following the process set out in clause 6, the date on which Your Plan begins.
4. Eligibility
4.1 All bikes from all brands are eligible for a Service Plan.
4.2 For a bike to be eligible, it needs to be in full working order at the time of purchasing a Service Plan.
4.3 Decathlon UK customers will need to have a Decathlon account. If not they will need to create it.
5. Customer Journey
5.1 A Plan will be sold to you by our employee, either by the cycling or the workshop department. You will be given a link to access these T&Cs for your perusal and consideration.
5.2 You will be accompanied to the till. A membership account will be created (if you do not have one) and the code for the Plan will be run through the till.
5.3 Our employee will then add the make, model and serial number to the transaction so the Plan is linked to the bike.
5.4 In the event that you pay for the transaction with any of the approved Payment Methods, it is an offer you made to us regarding the purchase of the Plan in accordance with these T&Cs.
5.5 Your Decathlon account will show that you have purchased the Plan and all elements of the Plan and usage will be recorded within your purchase history.
6. Right to Cancel and Other Statutory Rights
6.1 Provided you have not used any of the Benefits during any Cooling-Off Period you can cancel your Plan and receive a refund in any of our stores.
6.2 For the avoidance of doubt, if you have used your Benefits during the Cooling-Off Period before cancelling your Plan, or if you attempt to use your Benefits after cancelling your Plan, you will not be entitled to cancel your Plan and you will be liable to pay us the remainder of the fees due for the Plan.
6.3 We reserve the right to cancel orders that We believe to be placed for commercial purposes or are fraudulent (including where We believe there may have been credit card or a payment related fraud) or otherwise breach these T&Cs.
6.4 If We cancel Your order, you will be refunded in full. Prior to any such cancellation, We may contact You and discuss appropriate changes to Your order.
6.5 Notwithstanding anything to the contrary contained herein, nothing in these T&Cs limits or excludes your statutory rights as a consumer.
7. Liability & Disclaimers
7.1 Except where expressly stated otherwise and agreed in writing with You, We only supply the Goods or Services for domestic and private use. You agree not to use the Goods for any commercial, business or resale purposes, and We have no liability to You for any loss of profit, loss of business, business interruption, or loss of business opportunity.
7.2 We do not in any way exclude or limit our liability for: (a) death or personal injury caused by our negligence, (b) fraud or fraudulent misrepresentation, (c) any breach of the terms implied by section 9 to 11, or 17 of the Consumer Rights Act 2015, and (d) defective products under the Consumer Protection Act 1987.
7.3 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by an Event Outside Our Control. An Event Outside Our Control means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
8. Modifications & Termination
8.1 Decathlon UK reserves the right to vary these Terms by giving You no less than 30 days’ written notice of such variation via email and by making note of such changes available on www.decathlon.co.uk, so please review the website periodically for changes.
8.2 You shall not assign, transfer or otherwise dispose of all or any of your rights under these T&C.
8.3 Each of the clauses of these Conditions operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
9. Personal Data and Our Communication
9.1 Our Privacy Policy governs the use of your personal information submitted to Decathlon UK.
9.2 By purchasing a Service Plan, you acknowledge that it will be necessary for us to contact you from time to time in connection with our delivery of the agreed contractual service to you under these Terms. This contact will be limited to the communication necessary to provide the services outlined in these Terms, which means among others, to manage your account and to communicate with you regarding your use of our services. The lawful basis for this processing is Article 6(1)(b) of the UK GDPR, which permits processing that is necessary for the performance of a contract.
9.3 We will process your personal data for the purpose of marketing communication only if you have given us your explicit consent. You will have the right to withdraw your consent at any time, and the withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal. The lawful basis for this processing is Article 6(1)(a) of the UK GDPR, which permits processing based on the data subject’s consent.
10. Governing Law & Compliance
10.1 These Terms & Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.
10.2 Any disputes will be subject to the exclusive jurisdiction of the English courts.
11. Additional Terms
11.1 In addition to these terms and conditions, the following additional terms also apply to your use of Decathlon UK's mobile application and its associated features:
The Terms of Use govern your use of Decathlon UK's website, mobile application and your Decathlon account;
The Terms of Supply govern the Purchase on Decathlon UK's mobile application; and
